If we have an unavoidable emergency, if the weather or conditions are unsafe, if we are going to have to postpone the session.  (This goes both ways.)  We are pleased to allow one agreed upon back up date before a reschedule fee of $199 is assessed, long distance clients may have additional reschedule expenses due to non refundable travel fees and expenses etc.

IMAGE DELIVERY

I am passionate about printed products. 

My dream is for everyone to have tangible items created from their images that they can pass down to their babies continuously through the generations. Print your albums, line your walls... create tangible products of this investment you've made into commemorating your legacy.

Including digital images, I offer an array of print products to include albums and wall art. I would love to know how you would like to receive your images, and what you are interested in hearing about.  Selecting the options below doesn't mean you are contracted to purchase those items, it only means you are interested in hearing about your choices.

I am currently working on a series called the Don't Smile Stories - Messy Heart Journals.  This is a simple add on to the session where I step aside  for a few moments during the session and just take portraits of the individual adults.  The idea is that No Smile is required, or should even be allowed.  We're seeking the other emotions that we all feel on a the day of the session, or most profoundly in our lives at the time.  This is a chance to give yourself a moment to not have to conform in any way.  Really speak to the emotional depth you have, and how that translates to photographs.  We are documenting real life, we are capturing moments of reality. 

• Participation is completely optional, and there isn't an extra charge. 
• If you don't want to participate that is quite alright.  Just indicate below.
• If you are interested, before the session I would ask you to fill out an "interview" type questionnaire.  These answers will be the driving force, the inspiration, behind your portraits on the day of the session. The goal is to be open and honest and answer with complete transparancy.
• If you do take part, you'll have the opportunity to choose 5 of your favorite images to keep with the option to purchase more.  If you grant me permissions to use the images and your answers in my public work I will happily include all of your portraits in your session gallery.
• If you love your set of images and would like a tangible item to hold on to them, I can make an album to include your images, and your answers, to complete the story of you right now. You can think of this as a professional journal.  Some of your thoughts, some of your photos kept in a keepsake to last.  It is no mystery that stories of people can be lost in a moment, between loss of memory, loss of possessions, loss of life - to having something like an album for your children and grandchildren to hold on to can allow them to get to know you just a little bit more.  Canvas, Framed Prints, and Printed Images will also be available for purchase.

All sessions are natural light, lifestyle, documentary, on location, creative collaborations between photographer, partners, vendors, affiliates, and clients.  

Session fee is a retainer to reserve artists time, time of partnering vendors and affiliates, appointments, meetings, travel, permits, expenses, and session time and date for scheduled session(s). This fee, all or in part, is non-refundable.  The session fee is due at the time of booking with a fully executed contract (this document) and retains all session's time as scheduled.

Session fee requires at least 30% upon booking, the remaining balance will be sent by invoice and paid at the rate/amount you wish up until the week prior to the session; the balance in full must be paid by five days before the session date.

All decision makers must sign on behalf of all participants, must be present at all meetings, and all must accept final purchases.  In short, everyone with a vote must be on bored.

While no exact number of final images for review can be predicted, generally speaking 1 hour of solid session time, without breaks, and with consistent flow - will usually produce an average of 50 unique images to review - depending on the style of the session.  This is highly dependent on cooperation of everyone to produce variety within each set of photos.  Which means, if you want to have a ton of photos to choose from, you have to work the camera, my friend - WORK IT!  :)

All invoices and included fees and expenses are due upon receipt.

TRAVEL + PERMITS

Travel Fee and Location Permits will be added as a line item to clients initial invoice at Reveal and Ordering Appointment. Unless client pursues those permits themselves.  They must provide photographer with permits within a timely manner and upon request by photographer and may be necessary prior to booking travel and expense planning.

• Travel outside 30 miles from Photographers office will be charged one dollar per mile
• Traveling over 150 miles round trip will accumulate a per day per diem of $75
• Traveling over 150 miles will require a customized quote of per diem, travel expenses, lodging, etc.

ADDITIONAL PURCHASES

• Galleries will be available for one week to purchase images (if not all inclusive) and print products and download purchased images.
• Discounts and credits do not always stack or combine
• All sales, purchases, fees and invoices paid are final sale after 3 day cooling off period has expired (three calendar days after payment received).
• Any galleries or purchases left unfinalized, not downloaded, not completed after 30 days are subject to a re-initiation fee of $100 to reopen the project and will be at the scheduling convenience of the photographer.  There are no refunds for project left unfinalized at any point in the process.
• Pricing Menus are guaranteed throughout the contract services so long as account remains in good standing and current, but are liable to change without notice should a breach of contract, a contract expire, or unfinalized contract occur. 

Sales tax will always be charged separately.  Shipping may be an added expense in some circumstances.  Travel expenses may change and thus may be an additional addendum to the initial invoice.

REFUNDS, CREDITS, EXCHANGES, AND CANCELLATIONS 

There is a three calendar day cooling off period after payment to allow for corrections, amendments, or order changes.  For this reason, due to the customized and digital nature of the entire process all sales are final, there are no refunds, exchanges, or returns.

Should circumstances arise in which client cannot complete the session as contracted - the session fee, at the photographer's discretion, and on a case by case basis:

• is transferable to another date within similar photo session details.
• has an expiration date of 2 years following the originally contracted session date.

Cancellation must be prior notice and well communicated.  No Call No Shows, to include no shows, are not considered cancellations, but instead breach of contract, and will not be eligible for refund or reschedule, or re-contract.

Photographer and other vendor services, expenses, and other fees (rental dress, HMUA, venue, travel, location permits etc) may not transfer, may not be rescheduled, cannot be refunded, and will not be included in the purchase credit outlined above.

• Vendor retainer fees are not refundable under any circumstances, and will be re-charged upon reschedule in full to respect vendor's schedule, time, and policies.

Package bundles are complete packages and cannot be separated.  Should you choose a package bundle and decide to not obtain any part of it - the value will not be discounted, refunded, or credited in any other capacity.  Remaining balances on purchase credits will not be refunded nor credited.

• Images purchased through the gallery are available immediately to download, under no circumstances will there be refunds given for digital downloads.

If a manufacturers error is identified within 24 hours of receipt of a print product's delivery, immediate communication and photo documentation must occur in order to move forward with a possible replacement.

PAYMENT PLANS

A minimum of thirty percent of the session fee is due upon booking.  The remainder of the balance must be paid by the due date, generally a week prior to the session.

Any products purchased after the reveal of your images must be paid at the time of ordering. 

There are currently no advertised payment plan options.

LATE PAYMENTS

Late payments are a breach of contract and simply put, if full payment is not made prior to the session, the session will not take place.  No images or print products will be designed, ordered, or delivered until payments are made.  If a contract has lapsed or expired due to lack of payment, communication, or action the contract will be moved to a pending, non active state, and can incur the following:

LATE FEES FOR INVOICES UNPAID AFTER DUE DATE

• may be assessed in the form of .25% of the total per week overdue.
• Late fees do compound
• Promotions, purchase credits, discounts, deals, bonuses, additional included services, and shipping etc will not be applicable to any account that has been left unpaid, partially paid, paid late, cancelled or re-evaluated for termination of contract/invoice.

INVOICES PARTIALLY PAID

• refers to purchases made beyond the session fee
• are not refundable, exchangeable, or transferrable

Should client communicate they won't be able to complete their entire agreed upon invoiced commitment beyond the 3 Day Cooling Off Period:

• A $150 fee will be assessed to the invoice for renegotiation of final services rendered, products purchased and ordered, and images and products delivered. 
• Client will use their paid-balance to purchase images or products at investment menu pricing current to the date of the project reopening. 
• Promotions, purchase credits, discounts, deals, bonuses, additional included services, and shipping etc will not be applicable to any account that has been left unpaid, paid late, partially paid, cancelled, re-evaluated, or breach of contract for termination of contract/invoice.

Any and all applied fees and interest must be paid prior to renegotiation of paid balances use on invoices and before contract cancellation.

The session and all services following may be subject to cancellation

• without being fully executed: contract completed and fees paid in full
• noncommunication, nonpayment, non compliance, non cooperation, and non collaboration of appointments, meetings, session, and print product ordering, reviewing, and finalizing
• nonpayment at any point during contract
• nonpayment of payment plans after 60 days of no communication and no payment
• nonpayment of payment plans after 90 days regardless of communication efforts
• any harm that may come towards the photographer and team by the client in the way of: mental, emotional, or physical 
• theft by client that may include: digital images, wire fraud, non payment of invoiced fees due, and 
• for discretionary reasons that may not be outlined here

A $150 fee will be assessed to any account that has breeched contract for any reason and has been cancelled by the photographer.

• Any applied fees or interest must be paid prior to renegotiation of paid-balances use on invoices.
• Promotions, purchase credits, discounts, deals, bonuses, additional included services, and shipping etc will not be applicable to any account (unpaid invoice) that has been cancelled or re-evaluated for termination of contract/invoice.
• Paid balances left unused expire after two years of client contract breech/photographer cancellation.  Expired funds cannot be refunded, exchanged, transferred, or used to purchase images or products regardless of paid-balance.  Photographer absorbs all paid balances without obligation to client to refund or continue/negotiate/re-open contract agreement.
• Paid balances for image and print projects left unused may be refunded by client request and within the two year timeline described.  Any fees or monies owed applicable will be retained prior to refund.  Session fee, completed purchased products and images delivered will not be refunded, credited, exchanged.
• "Paid Balances" in this section of the contract refers to money paid for image and print projects (albums, wall arts, etc) but left pending and thus incomplete by the client.  Photographer will assist in furthering the project with reminders and support as much as client accepts.  Projects started but incomplete may fall into this category.  Either way, all fees applicable will be retained from the credit before refunding.

PHOTOGRAPHER SAFETY

Photographer retains the right to refuse or continue contracted services, and cancel contracted services, with any client who proves profane, disrespectful, harmful, harassment, aggressive verbally, physically, or emotionally in any capacity, non reliable, routinely late or no-show to meetings, appointments, sessions, at any time during contracted services.

Photographer and team retains the right to end the session immediately in the case of abuse, mistreatment, harassment, unsafe environment etc, directed toward, or in the direct vicinity of, photographer or team.  This could lead to immediate refund of any monies available left to refund (sans fees, travel, per diem, etc and is at photographer's discretion), purchase credits will be refunded in this case only.  Images will be deleted immediately, will not be process or released nor revealed under any circumstances to client.

• A $500 fee per hour, per person on the working team, will be charged to client and may be retained from the credit or fees paid, for each hour left in the contract for Wedding Coverage after photographer ends coverage due to abuse, mistreatment, harassment, etc. 

Cancelled contracts, for any reason, will result in discretionary right to no longer work with client in the future.

SCHEDULE AND TIMELINE

Generally

• The session is booked out 30 days from consultation.
• The session length is dependent on the type of session, and is outlined in the session details.
• Gallery delivery is approximately 4 weeks after session.
• Gallery is available for 7-10 days to finalize orders.
• Print Product creation and order is approximately a two week process and highly depends on communication and cooperation compliance of client.
• Product delivery is generally between 30 and 60 days post order.

OFFICE HOURS

My hours are largely based on clients schedules for appointments and meetings.   Office hours however fall under 9-6pm timeframe when I am available via phone, email, or text. 

POST PRODUCTION REQUESTS

Images are subjected to creative vision.  But there may be times you as the client may want a LITTLE change 

• I choose my black and white images carefully.  Sometimes it comes down to - it just didn't look as good in color as it did in black and white.  If you want it changed to color (or BW to color) I will happily change it over but know that it may not be consistent for one reason or another with your other like images.  

The following examples of an impossibly non-exhaustive list will incur a minimum of a $25 fee per image per request: 

• Whisps of hair clean up, teeth whitening, hair tie/watch removal, bra strap showing, clothing wrinkle 

Extreme body modification requests will never be enacted as we believe the body you are in, right now, deserves its time to be documented and respected.  

HEALTH AND WELLBEING

Client agrees to communicate immediately if someone is not well enough to move forward and the session needs rescheduling.  Photographer appreciates the same respectful understanding and flexibility if necessary.

MINORS

By signing, you as the guardian agree that you

• are consenting on behalf and in cooperation with all minors participating to be photographed by the contracted company s a schinsky photography
• agree your minor is also consenting to be photographed
• will stay present for the entire duration of the session with your minor(s)
• are signing the contract on behalf of your minor, with your minor's consent
• acknowledge that all contracted agreements here fall as an umbrella to cover minors rights, consent, privileges, and privacies as outlined 

All Minors' consent will be taken seriously.  Setting aside toddlers being toddlers, or someone having a hard day - some minors may truly not want to be photographed.  If necessary, we will have boundary setting conversations, in their favor, should they agree to move forward with the session.

BOUDOIR AND SPICY SESSIONS

Or any sub category of will never include anyone under the age of 21 years old, under any circumstances, ID will be requested.

ON THE TOPIC OF HONESTY

This should go without saying, but the blurry grey lines of our current digital age can sometimes run away with our moral compass.  The following practices are dishonest:

• Sharing the work of a photographer/artist/creator as your own (or uncredited) is theft of their intellectual property.  
• Using screen shot/snip etc. it when you are given permissions and privileges to view the images electronically is theft of their intellectual property; and also please know you are not getting a quality "digital file" when you do this.
• Changing the images in any capacity after you've received them.

In this contract - any images you paid for are yours to do with as you please.  Please treat all of your hired creatives the same.  Their work is hard, emotional, and constant. 

Any client known to have stolen images will be invoiced.  If invoice remains unpaid and client refuses to correct their mistakes - I will choose to not do future business with them.

Further, your personal information is always safe here.  We will never sell or distribute it without permissions.  More importantly, you are safe here.  This is a safe space for everyone who wants to be here.  Feel free to come exactly as you are.

LIABILITY RELEASE

Photographer cannot be held liable for circumstances outside of natural control that cause loss of ability to produce promised services ie: loss of digital images due to technology malfunction, illness where it would be socially responsible to not attend social functions, injury, natural disaster, weather, death, or property damage.  Refunds will not be given, funds may be transferred as stated above.  A replacement photographer will be attempted to be found but not guaranteed.  This would be as much of a disappointment for me as it would for you!  I will do my best to make it right.  Client cannot hold photographer, nor heirs or family, personally, professionally, financially responsible.

FOR THE CLIENT

You may print the images, send them to whomever, use them, and love them.  Please be considerate of a large amount of time in creation and avoid adding your own creative twists.  Images can be used for headshots, blogs, personal use etc.

If technology fails you - contact us to retrieve any lost files purchased in the past.  We keep purchased items until technology fails us.  Any un-purchased files are held for 30 days and then are subjected to be let go of permanently due to space efficiency.  There is an archival fee for us to hold on to unpurchased files of $150 per year.

When it comes to printing on your images using your digital files - be cautious of using quantity over quality labs. MPIX and Artifact Uprising are public pro-labs that do great work.

THE PHOTOGRAPHER

ARTISTIC STYLE: The client acknowledges, they are familiar with the photographer's current portfolio and is requesting services with this knowledge.  Photography is art.  The work as a whole is constantly evolving, changing, and growing.  Services are unique and artistic in nature.  Photo planning, prepping, capturing, post processing, and editing may look different than it has in the past and most certainly will change in the future. Photographer can use artistic judgement throughout process to create images consistent throughout the gallery, consistent with session environment, consistent with personal vision of the event, which may be different from client's vision - and that is okay, it is still going to be beautiful work as we strive to go for the feeling of a photograph over the look of any style.  Small requests in small changes may be accepted, photographer will not change the current style to fit the clients vision or interest.  There will be no refunds based on agreement.

Photographer owns all artistic creation including image copyright.

Raw or unfinished photos will not be released to client(s) and remain under the ownership of the photographer solely.

Model Permissions are optional and are a privilege for the photographer to obtain.  Client's choices are respected wholly at any stage of the process.

Please note vendors may have their own Model Release Policies that must be discussed with you in order to waive, if that is your choice.  s a schinsky photography cannot rescind permissions on your behalf.  It will be assumed you grant permissions to all contracted vendors, affiliates, partners, etc with the granted permissions here.  However, if permissions are different for each vendor this is a responsibility of the client to approach and agree to each of those vendor's policies separately.

MODEL CALL

If your session is a MODEL CALL permission granted is required to move forward with the agreed upon session, details, pricing, commitment, offers, and benefits/perks.  Please remember all decision makers must sign on behalf of all participants, must be present at all meetings, and all must accept final purchases.  

FAQ: What if I go through the session and see the photos and decide I don't want to grant permissions?

A: I will respect your wishes entirely!  We will discuss details, but generally if we are at the stage of gallery reveal and you decide, after seeing the images, you don't want them shown publicly you will be invoiced for the cost of the session and all of its entities and all previously agreed upon model call benefits will be included in this invoice. 

If you decide you don't want your images used publicly after you've been gifted your bonuses for model call, an invoice will be sent and you will be requested to pay for your session and purchases/gifted investment retroactively before model call permissions are rescinded.

GOOGLE REVIEW

In return for your honest review I would love to offer you an 8x12 print of your choice to be delivered after your review is posted to Google and Facebook after our contract is completed.

By signing you agree that you acknowledge, understand, and agree to the entirety of the contract, and all of its contents, future verbal or written communicational agreements and arrangements, that your electronic signature on this form and any others with s a schinsky photography is valid and acknowledged as an authentic signature by all standards.  By signing you agree to receive communications of all types from s a schinsky photography throughout the duration of your contract with s a schinsky photography.
